Part I: Photo/Video Release I grant to Krav Maga Instruction By Robbins LLC, its Representatives and Employees the right to take photographs of me, my children, and my property in connection with and any/all of its programs, classes, and events. I authorize Krav Maga Instruction By Robbins LLC, its assigns and transferees to Copyright, use and publish the same in print or electronically. I agree that Krav Maga Instruction By Robbins LLC may use such Photographs, as described above, with or without my name and for any lawful purpose, including for example such purposes as Publicity, Illustration, advertising, and web content. Part II: Liability Release In consideration for my attendance and participation in physical fitness training offered by Krav Maga Instruction By Robbins LLC; I, the student/parent, acknowledge the existence of certain inherent risks in this type of training and hereby agree to release and discharge Krav Maga Instruction By Robbins LLC on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows: 1. I further relieve Krav Maga Instruction By Robbins LLC, its management, assigned staff, and fellow students from any liability resulting from loss, whether personal belongings or bodily injury. 2. I also hereby state that myself, or my child, is physically fit to take the prescribed course of instruction and do so of my own free will in exchange for an agreed upon fee. 3. I understand that there is no refund policy on any monies I will pay Krav Maga Instruction By Robbins LLC. 4. I certify that I have read, understand and comply to agree with all of the rules and regulations of Krav Maga Instruction By Robbins LLC. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Krav Maga Instruction By Robbins LLC and the facility where my participation took place on the basis of any claim from which I have released herein. Part III: Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Krav Maga Instruction By Robbins LLC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Krav Maga Instruction By Robbins LLC or participation in programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Krav Maga Instruction By Robbins LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Krav Maga Instruction By Robbins LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any program. I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS. By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to use, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature.
